The new breastfeeding law

The Legislative Assembly approved the Law Love Converted into Food for the Promotion, Protection and Support of Breastfeeding, which aims to “promote, protect, support and prioritize breastfeeding in the first thousand days of life”. The new breastfeeding law is a regulation presented by the Central Government.

Said law comes to replace the Law for the Promotion, Protection and Support of Breastfeeding passed in 2013, which granted working women one hour a day during their working day to feed their children in clean spaces within the facilities; however, the lack of this place was not considered as a minor, serious or very serious infraction.

With the Law of Love Converted into Food, all public and private institutions where they work or provide specialized attention to women of childbearing age, pregnant women and nursing mothers must install breastfeeding rooms and guarantee their operation.

Likewise, the new regulation establishes as a very serious infraction the non-compliance in the installation of breastfeeding rooms and the institution must pay a fine of 11 to 50 minimum monthly salaries of the commerce and services sector.

Our associate attorney of the Department of Labor and Immigration, Daniela Deras, calls on all companies, businesses and state institutions to comply with the law. “Public and private institutions must install a breastfeeding room so that their employees can feed their children and properly conserve their milk. Otherwise, they may fall under sanctions, a possible closure of the establishment and restitution measures,” she added.

The Executive Branch, through the Ministry of Labor and the Ministry of Health, will carry out permanent inspections in workplaces to ensure compliance with this provision. 

The installation of the Breastfeeding Rooms will be enforceable to public and private sector employers 90 days after the entry into force of the regulation of this law. Likewise, the legislation will enter into force 180 days after its publication in the Official Gazette of the Federation.
